Federal Appeals Court Overturns Death Sentence For Amarillo Woman

A federal appeals court is sending a death row inmate’s case back to the trial court after overturning her 1998 murder conviction.

The U.S. 5th Circuit Court of Appeals made the ruling last week after determining that the prosecutors hadn’t revealed that their main trial witness was a paid informant.

Brittany Holberg was found guilty of robbing and murdering an elderly man in his Amarillo home. The informant recanted her testimony in 2011. The appeals court said the prosecution violated Holberg’s due process rights by hiding information.
