Judge Voids Votes Cast In San Benito City Charter Election

A district judge has nullified the votes cast in the special election in San Benito on five proposed amendments to the city charter, and has blocked any further voting on the measures.

The decision came in a lawsuit that claimed city officials violated the Texas Open Meetings Act by failing to give proper notice before putting the proposed charter amendments on the ballot. The ruling means the early votes already cast in the special election will not count, although the city attorney for San Benito has said the city will appeal.

The judge issued his ruling Monday, a week after hearing arguments in the lawsuit. Among the five ballot measures are two that would require the city manager and city commissioners to reside in San Benito.
