Texas Attorney General Ken Paxton is asking the state Supreme Court to dismiss its order delaying the execution of Robert Roberson III. In the Saturday petition, Paxton’s office argues the court has no jurisdiction over the case.

The court’s order granted Roberson a subpoena to testify tomorrow before a House Committee. He’ll testify about how a law that allows Texans to challenge convictions based on outdated science applies to his case. Roberson was found guilty of killing his young daughter in 2003, with prosecutors arguing she died due to “shaken baby syndrome.”
